Terms of Use — Curated Classics AI
Draft prepared by AI, not legal advice; have a BC lawyer review before launch.
Effective date: October 24, 2026
These Terms of Use ("Terms") govern your use of the Curated Classics AI website, currently in preview at caa-staging.pages.dev and intended for curatedclassicsai.com (the "Site"), and of the images, collections, tools and services we offer through it (together, the "Services"). The Site is operated by [LEGAL ENTITY NAME] under the brand "Curated Classics AI" ("we", "us", "our").
1. Acceptance of these Terms
1.1 By accessing the Site, downloading an edition, submitting content or buying a license, you agree to these Terms. If you do not agree, do not use the Services. 1.2 If you use the Services for a business, you confirm you are authorized to accept these Terms for that business, and "you" includes that business. 1.3 You must be at least the age of majority where you live, or use the Services with the consent of a parent or guardian.
2. Public-domain originals and The Met
2.1 The original paintings behind our editions are in the public domain. Our source images come from The Metropolitan Museum of Art's Open Access program, released under Creative Commons Zero (CC0). 2.2 Curated Classics AI is independent. We are not affiliated with, sponsored by or endorsed by The Metropolitan Museum of Art. References to "The Met Open Access" identify the source only. 2.3 Nothing in these Terms limits anyone's right to use the public-domain originals directly from their source.
3. Our copyright
3.1 © 2026 Curated Classics AI in the human-authored selection, arrangement, curation and edits of our editions and collections, and in the Site's text, design and software. 3.2 Our editions are extended to 16:9, upscaled and finished with AI assistance. AI-assisted elements may not be protected by copyright in every jurisdiction. Where they are not, our rights extend only to the human-authored parts and to the contractual permissions set out in these Terms. 3.3 "Curated Classics AI", our logo and the "CCAI" mark are our brand identifiers. You may not use them in a way that suggests we endorse you or your product.
4. Free downloads during the preview
4.1 While the Site is in preview, you may download our editions free of charge. 4.2 We grant you a personal, non-exclusive, non-transferable, revocable license to download and display editions for personal, non-commercial use only, for example on your own art TV, monitor, computer or printed for your home. 4.3 You may not: (a) sell, resell, rent or license editions or collections, alone or as packs or sets; (b) redistribute editions, packs or collections, including by re-uploading them to other sites, apps, marketplaces or file-sharing services; (c) use editions in commercial products, advertising or public commercial display (see Section 6 for business use); (d) use editions, or collections of them, to build, train, fine-tune or evaluate machine-learning or AI models or datasets; or (e) remove or alter copyright or source notices. 4.4 The preview terms may change when the preview ends. Copies you downloaded for personal use during the preview remain available to you for that personal use.
5. User content on "Curated by" (/curated/)
5.1 What you can submit. You may submit a curation, such as a title, an optional nickname (public alias) and an explanation ("User Content"). Submissions are limited to 3 per day per user, or another limit we post. 5.2 Your promises. You confirm that you own your User Content or have all rights needed to submit it, and that it does not infringe anyone's rights or break any law. 5.3 License you give us. You keep ownership of your User Content. You grant us a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, translate, adapt for formatting, and moderate your User Content on the Site and in promoting the Site, for as long as it remains on the Site plus a reasonable period to remove it from backups and caches. 5.4 No personal information. Do not include personal information about yourself or anyone else (for example full names, addresses, phone numbers or emails) in User Content. Your nickname is public. 5.5 Prohibited content. No illegal, infringing, defamatory, hateful, harassing, sexually explicit, violent or spam content, and no malware or links to it. 5.6 Moderation. We may review, edit for formatting, refuse, hide or delete User Content at any time, with or without notice. We do not have to publish anything. 5.7 Reporting and deletion. You can report content using the report link on the Site or by email to [CONTACT EMAIL]. You can ask us to delete your own User Content by the same email. 5.8 Copyright notices (Canada). If you believe content on the Site infringes your copyright, send a notice to [CONTACT EMAIL] that identifies you, the work, the content and its location on the Site, and your claimed rights. Where the notice-and-notice regime under the Copyright Act (Canada) applies, we will handle notices as that regime requires, including forwarding them where applicable. We may also remove content we believe infringes.
6. Business per-screen license (/business)
6.1 Summary only. This section summarizes our business license for public display (for example in hotels, offices and clinics). The order form, quote or price list you accept ("Order") sets out the commercial details. If the Order conflicts with this section, the Order controls. 6.2 One license per screen. Each license covers display on one display screen at the location stated in the Order. Each additional screen needs its own license. 6.3 Scope. You may publicly display licensed editions on licensed screens during the term. You may not sublicense, resell, redistribute or transfer the license, or use editions outside the licensed screens, without our written consent. 6.4 Trial. Where offered, a free trial lasts 14 days, or the period stated in the Order. Unless you cancel before the trial ends, a paid subscription starts as described in the Order. 6.5 Term and renewal. Licenses are priced per screen per month (or as stated in the Order) and renew automatically for successive periods of the same length unless you cancel before the renewal date. 6.6 Cancellation and refunds. You may cancel at any time; cancellation takes effect at the end of the current paid period. Fees already paid are non-refundable except as stated in the Order or required by law. 6.7 Fees and taxes. Fees are in the currency stated in the Order and exclude taxes. You pay applicable taxes, including GST/HST and provincial sales tax where applicable. Payments are processed by our payment provider (such as Stripe) under its own terms. 6.8 Termination for breach. We may suspend or end a business license if you materially breach these Terms or the Order and do not fix the breach within 10 days after notice, or immediately for non-payment or unauthorized redistribution. On termination you must stop displaying the editions.
7. Future purchases and affiliate links
7.1 If we sell products or licenses, prices, taxes (including GST/HST where applicable), delivery and refund terms will be shown at checkout and form part of these Terms. 7.2 Some links on the Site may be affiliate links, meaning we may earn a commission if you buy through them at no extra cost to you. We will label them. We are not responsible for third-party products, sites or terms.
8. Room matcher (/match)
8.1 If you use the room photo feature, the photo is processed in your browser and is not uploaded to our servers. 8.2 Taste descriptions you type are sent to a third-party AI service (Cloudflare Workers AI) to produce recommendations and are not stored by us. Do not include personal information in them. 8.3 Recommendations are suggestions only, with no guarantee of fit or accuracy.
9. Acceptable use
You agree not to: (a) break any law or anyone's rights while using the Services; (b) scrape, bulk-download, crawl or harvest the Site or editions by automated means, except search engines following our robots rules; (c) interfere with, overload, probe or bypass the security of the Site; (d) reverse-engineer the Site's software except where the law allows it; (e) impersonate any person or misrepresent an affiliation with us or The Met; or (f) use the Services to send spam or malware.
10. Privacy
Our Privacy Policy at /privacy explains how we collect and use personal information. By using the Services you acknowledge it.
11. Disclaimer of warranties
The Services and all editions are provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement, accuracy of artwork information, and uninterrupted or error-free operation. Colours and quality may vary by device.
12. Limitation of liability
12.1 To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill. 12.2 To the maximum extent permitted by law, our total liability for all claims relating to the Services is limited to the greater of (a) the fees you paid us in the 12 months before the claim arose, and (b) CAD $100. 12.3 Consumers. Nothing in these Terms excludes or limits rights or remedies you have under consumer-protection laws that cannot be excluded or limited by contract, including in British Columbia, your province or your country.
13. Indemnity
To the extent permitted by law, you will defend, indemnify and hold harmless [LEGAL ENTITY NAME] and its directors, officers, employees and contractors from claims, losses and costs (including reasonable legal fees) arising from your User Content, your breach of these Terms or your misuse of the Services. This does not apply to the extent the claim is caused by our own breach or negligence.
14. Termination
14.1 You may stop using the Services at any time. 14.2 We may suspend or end your access to all or part of the Services if you breach these Terms, if required by law, or if we discontinue the Services. Where reasonable, we will give notice. 14.3 Sections 3, 4.3, 5.3 (for content already published), 9, and 11 to 18 survive termination.
15. Changes to these Terms
We may update these Terms. We will post the updated Terms on this page with a new effective date and, for material changes affecting paid licenses, give reasonable advance notice by email or on the Site. Continued use after the effective date means you accept the updated Terms. Changes do not apply retroactively to fees already paid.
16. Governing law and courts
These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable there. The courts located in Vancouver, British Columbia have exclusive jurisdiction, except where consumer-protection law gives you the right to bring a claim in your own jurisdiction.
17. Severability and entire agreement
17.1 If any part of these Terms is found unenforceable, it will be limited to the minimum extent necessary and the rest will remain in effect. 17.2 These Terms, our Privacy Policy, and any Order are the entire agreement between you and us about the Services and replace prior understandings on the subject. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a reorganization or sale of the business.
